Copyright Policy

Last updated: October 22, 2026

ClipHaus respects the rights of copyright owners and other rights holders. We provide a clipping service for podcast episodes that clients submit to us, and we expect every client to submit only material they have the rights to use. This policy explains how to report material you believe infringes your rights, how the person who submitted it can respond, and what happens to accounts that repeatedly submit infringing material.

This policy follows the notice and counter-notice approach used under the United States Digital Millennium Copyright Act (DMCA) and applies it to reports we receive from any country. It forms part of our Terms of Service.

1. Creators warrant their rights at submission

Under Section 4.2 of the Terms, every creator warrants at the time of submission that they own, or hold all rights, licences, consents, and permissions needed in, the episodes and other material they submit, covering hosts, guests, music, footage, and any other material in the episode. We rely on that warranty and do not clear rights in client content. A takedown notice does not transfer that responsibility to us, and the submitting creator remains responsible for the rights position of their submissions, including under the indemnity in the Terms.

2. How to submit a takedown notice

If you are a rights holder, or acting for one, and you believe that an episode submitted to us, a finished clip we produced, or other material handled through the Service infringes your copyright or other rights, send a written takedown notice to:

legal@arafatarzu.me

To be effective, your notice must include all of the following:

  1. Identification of the work. Identify the copyrighted work, or other protected material, that you claim has been infringed. Where several works are involved, you may provide a representative list.
  2. Location of the material. Identify the material you claim is infringing and where it can be found, with enough detail for us to locate it: a URL where the clip or episode appears, or, where there is no public URL, the show name, episode title or number, and any clip title or other reference you have.
  3. Your contact information. Your full name, the organisation you act for (if any), a postal or email address we can reply to, and a telephone number if you are willing to be contacted by phone.
  4. Good-faith statement. A statement that you have a good faith belief that the use of the material in the way complained of is not authorised by the rights holder, its agent, or the law.
  5. Accuracy statement. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or are authorised to act on the rights holder’s behalf.
  6. Signature. Your physical or electronic signature, or the signature of a person authorised to act for the rights holder.

Notices that are missing these elements may not be effective, and we may ask you to complete them before we act. Please do not send notices about material that is not handled through the Service: clips are published by our clients on their own channels, and removal from a video or social platform must also be requested through that platform’s own reporting process.

3. What happens after a valid notice

  • We review the notice and, where it is valid on its face, promptly remove or disable access to the identified material within the Service, which may include removing finished clips from delivery, pausing related jobs, and preserving the relevant records.
  • We notify the creator who submitted the material, give them a copy or a summary of the notice (redacting contact details where appropriate), and tell them about the counter-notice process in Section 4.
  • Where a notice covers a whole episode or show, we may pause further clipping from that episode or show while the report is resolved.
  • Material removed under this policy is not restored unless the counter-notice process is completed, the reporter withdraws the notice, or a court orders otherwise.

Submitting a knowingly false or misleading notice can carry legal liability for the person who sends it. If you are unsure whether material is authorised, for example because it may be licensed, quoted for review, or covered by an exception such as fair use, consider getting legal advice before sending a notice.

4. Counter-notice process

If your material was removed or disabled because of a takedown notice and you believe the removal was a mistake, or that you are authorised to use the material, you may send us a counter-notice at legal@arafatarzu.me. Your counter-notice must include:

  1. your full name, address, and the email address on your account;
  2. identification of the material that was removed and where it appeared before removal (URL, or show, episode, and clip reference);
  3. a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification, or that you are authorised by the rights holder, its agent, or the law to use it;
  4. a statement that you consent to the jurisdiction of the courts for the place where you operate (or, where the DMCA applies, the federal district court for your address), and that you will accept service of process from the person who sent the original notice; and
  5. your physical or electronic signature.

When we receive a valid counter-notice, we will forward it to the original reporter. Unless the reporter tells us, within 10 to 14 business days of our forwarding it, that they have started court proceedings to restrain the material, we may restore the material or re-enable access to it. Restoration is at our discretion where we have other grounds, for example under our Acceptable Use Policy, to keep the material or the account disabled.

5. Repeat-infringer policy

Accounts that repeatedly submit infringing material are suspended. In practice:

  • each upheld takedown is recorded against the submitting account and organisation;
  • we warn the account holder after an upheld takedown and may pause submissions while a report is reviewed;
  • an account or organisation whose submissions are the subject of repeated upheld takedowns, or a single deliberate and serious infringement, will be suspended or terminated, and pending accounts in the same organisation may be declined; and
  • editors who knowingly work on or distribute material they know infringes another person’s rights may also have their accounts suspended.

Suspension under this policy does not remove the creator’s obligations under the Terms, including payment for work already delivered and the indemnity for their content.

6. Trade marks and other rights

The same reporting route, legal@arafatarzu.me, can be used for trade mark, publicity, or other rights complaints about material handled through the Service. Include the same information listed in Section 2, adapted to the right you rely on, and we will review the report in the same way.
